PBGC Announces New General Counsel Appointment

The Pension Benefit Guaranty Corporation (PBGC) on Feb. 23 announced the appointment of Russell Dempsey as General Counsel.

In that capacity, Dempsey will provide advice and counsel for the PBGC Director and the agency on legal and regulatory issues, including: 

  • enforcement of Title IV of ERISA through litigation, negotiation, drafting regulations and guidance;
  • making decisions on administrative appeals; 
  • administration of the Freedom of Information Act; and 
  • providing advice to the PBGC on corporate governance, ethics, procurement, labor relations and privacy.

Dempsey has served as the Associate General Counsel of AIG in Houston, TX, and as the Senior Vice President and Chief Operating Officer for United Retirement Plan Consultants. Earlier, he served as an attorney in the Employee Plans Division of the IRS. The PBGC reports that has provided counsel on issues such as retirement plan design and administration, plan terminations, bankruptcy filings, regulatory matters, litigation, security, compliance and corporate governance. 

PBGC Director Gordon Hartogensis in a press release expressed confidence that Dempsey’s “leadership and expertise will help inform and guide our efforts to support the agency’s mission and protect the retirement security of the individuals who rely on us.”
